SUMMARY:Presidential Administration in a Polarized Era
DESCRIPTION:When Elena Kagan published her article on “Presidential Administration” twenty years ago\, she analyzed history but also helped to shape constitutional doctrine and narrative; \nThe twentieth anniversary of now-Justice Kagan’s article is the natural time to look back at recent debates\, and to look forward at possible paths for reform. To that end\, the Gray Center recently hosted a research roundtable to discuss seven new working papers\, on various aspects of presidential administration. The authors will present their papers on panels with commentary from other experts. We’ll also be joined by two authors of recent new books on presidential power. \nTo view the Agenda and to Register for the conference\, click here.

SUMMARY:The Constitutionality of Anti-BDS Laws: What the First En Banc Decision Might Say
DESCRIPTION:In the past seven years\, over thirty states have passed “anti-BDS laws.” These laws characterize boycotts of persons or companies based on their Israeli identity as a form of discrimination—and restrict state contracting or investment with companies that engage in such conduct. They have been challenged on Free Speech ground in several cases across the country. The Eight Circuit has recently heard arguments en banc on the issue\, and its ruling will be the most significant judicial pronouncement on the issue. This panel will debate the issues involved and discuss what the en banc 8th Circuit might rule. \nSpeakers:\nProfessor Amanda Shanor\, University of Pennsylvania\, Wharton School\nProfessor Eugene Volokh\, UCLA Law School\nSeth Waxman\, WilmerHale\, former U.S. Solicitor General \nThe event will be moderated by Professor Eugene Kontorovich\, Director of CMEIL. \nThis event will be hosted over Zoom on Tuesday\, October 26\, 2021 from 12 PM to 1:30 PM.\nZoom link: https://gmu.zoom.us/meeting/register/tJEqcOuhpzkpHtaqC_EaX1CAY64p-CnFi1JI \nCMEIL is funded in part by a generous grant from the Goldhirsh-Yellin Foundation.
